1.3 No Provider-Patient Relationship

Your use of this Website does not create a provider-patient relationship between you and DeluxMed or any of its clinical staff. A provider-patient relationship is only established when all three of the following conditions are met:

You have received care services from our clinical team under a formal clinical agreement

Communications through the Website, including form submissions, emails, or any other digital means, do not establish a provider-patient relationship.

1.4 Intellectual Property

All content on the DeluxMed Website — including text, graphics, logos, images, audio clips, digital downloads, and software — is the property of DeluxMed Health Group LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and view Website content for your personal, non-commercial use only. You may not:

  • Reproduce, distribute, or publicly display any Website content without our prior written permission
  • Modify or create derivative works from Website content
  • Use Website content for any commercial purpose

You agree to indemnify, defend, and hold harmless DeluxMed Health Group LLC, its officers, directors, employees, clinical staff, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit through the Website.

1.11 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Baltimore City, Maryland. You consent to personal jurisdiction in such courts and waive any objection to the laying of venue in such courts.

1.12 HIPAA Alignment Statement

These Website Terms of Service operate alongside and are subordinate to our HIPAA Notice of Privacy Practices and applicable healthcare laws and regulations. In the event of any conflict between these Terms and applicable healthcare law — including HIPAA, HITECH, 42 CFR Part 2, or Maryland health information privacy laws — the applicable healthcare law controls. Nothing in these Terms shall be construed to limit or waive any rights you have under HIPAA or other applicable healthcare privacy laws.

1.14 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining Terms and shall not affect the validity or enforceability of the remaining provisions.

1.15 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Website, constitute the entire agreement between you and DeluxMed regarding your use of the Website and supersede all prior or contemporaneous communications and proposals — whether electronic, oral, or written — between you and DeluxMed with respect to the Website.

SMS Terms and Conditions

This section constitutes the SMS Terms and Conditions for text message communications between DeluxMed Primary & Behavioral Health Services and individuals who have opted in to receive text messages from us. These terms comply with the Telephone Consumer Protection Act (TCPA) and applicable carrier requirements.

2.1 Program Description

DeluxMed Primary & Behavioral Health Services may send text messages to patients and prospective patients who have provided their mobile phone number and consented to receive SMS communications. Text messages may include:

  • Appointment reminders and scheduling confirmations
  • Patient care updates and follow-up notifications
  • Billing inquiries and payment-related notifications
  • Health-related informational messages relevant to your care
  • Responses to text messages you initiate

2.2 Consent to Receive Text Messages

You consent to receive text messages from DeluxMed at the mobile phone number you provided when you:

  • Check an opt-in checkbox on our website or intake forms indicating consent to receive text messages
  • Provide your phone number and agree to SMS communications during the appointment scheduling process
  • Text a keyword to 443-452-3692 to initiate a text message program

2.3 Message Frequency

Message frequency varies based on your care needs and appointment schedule. The number of messages you receive will depend on factors including appointment frequency, care plan requirements, and messages you initiate. You may receive up to 20 SMS messages per week related to your appointments, care updates, billing, and other programme communications.

2.4 How to Opt Out

You can cancel the SMS service at any time using any of the following methods:

2.6 Message and Data Rates

Message and data rates may apply to all messages sent to you from us and to us from you, depending on your mobile carrier plan. Contact your wireless carrier for information about applicable rates. DeluxMed is not responsible for any charges imposed by your mobile carrier for SMS messages.

2.7 Carrier Liability

Carriers (mobile network operators) are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to the terms and conditions of your mobile carrier. Factors such as network availability, message volume, and carrier routing may affect delivery timing.

2.8 Supported Carriers

Our SMS program is available through all major U.S. mobile carriers. Carrier participation may vary. If you experience persistent issues receiving messages, contact your mobile carrier or contact us directly at 443-452-3692.

2.9 Privacy of Text Message Data

The information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes. Information collected through our SMS programme — including your mobile phone number and opt-in consent records — is governed by our Privacy Policy, including the SMS Zero-Sharing Statement in Part III of that Policy. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent records will not be shared with any third parties.

2.10 SMS Communications and HIPAA

When text messages relate to your healthcare — such as appointment reminders — they may involve Protected Health Information (PHI) subject to HIPAA protections. We implement appropriate safeguards for healthcare-related text messages.
